Terms of Service

By downloading, installing, or using Decipher (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

Decipher is an AI-powered reflection and communication-support tool. It helps users notice what may have been said, felt, or unspoken in a conversation and offers possible grounded ways to respond. The Service is intended for personal reflection only.

Decipher provides reflective and communication-support tools only. Decipher is not therapy, counseling, crisis intervention, diagnosis, or treatment.

You must be at least 17 years old to use Decipher. By using the Service you represent that you meet this age requirement and that you are legally permitted to enter into these Terms in your jurisdiction.

You are responsible for the content you submit and for any actions you take based on AI-generated reflections. You agree to use your own judgment, and to consult qualified professionals where appropriate, when making personal, relational, medical, legal, or financial decisions.

You agree not to submit content that belongs to someone else if you do not have a reasonable basis to do so, and to avoid submitting highly sensitive personal information about others unless necessary for the reflection you are requesting.

Reflections produced by Decipher are generated by AI models and may be incomplete, inaccurate, biased, or otherwise imperfect. They represent one possible interpretation of the information you provided — not objective truth, and not a professional opinion.

You should never rely on Decipher's output as the sole basis for an important decision. Always apply your own judgment and seek qualified human advice when the situation calls for it.

Decipher does not provide and is not a substitute for:

• Medical advice, diagnosis, or treatment
• Mental-health therapy, counseling, or crisis intervention
• Legal advice
• Financial advice

You agree not to:

• Submit content that is unlawful, harmful, or harassing
• Use the Service to harass, threaten, or harm another person
• Attempt to extract, reverse-engineer, scrape, or interfere with the Service or its underlying models
• Use the Service to develop a competing product
• Submit content that infringes another party's rights
• Attempt to bypass safety, rate, or abuse-prevention measures

All Decipher branding, software, interface design, and original written content are owned by Decipher and protected by applicable intellectual-property laws. You retain ownership of the content you submit. By submitting content, you grant Decipher a limited, non-exclusive license to process that content solely to provide the Service to you.

You and Decipher acknowledge that these Terms are entered into between you and Decipher, and not with Apple Inc. Decipher is solely responsible for the Service and its content. Apple has no obligation to provide any maintenance or support services with respect to the Service.

In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.

Decipher, not Apple, is responsible for addressing any claims you or any third party may have relating to the Service, including but not limited to product-liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.

Decipher, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the Service or your use of it.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You and Decipher acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, misused the Service, or created risk for Decipher or other users. You may stop using the Service at any time by uninstalling the app. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability. Decipher does not warrant that the Service will be uninterrupted, error-free, or that any reflection produced by the Service will be accurate or appropriate for your situation.

To the fullest extent permitted by law, in no event will Decipher, its affiliates, or its providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service — even if advised of the possibility of such damages. Decipher's total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid Decipher in the twelve months preceding the claim or twenty U.S. dollars (USD $20).

You agree to indemnify and hold harmless Decipher and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. To the extent permitted by law, any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you may have under the laws of your country of residence.

We may modify these Terms from time to time. Material changes will be reflected by updating the Effective Date at the top of this page. Your continued use of the Service after a change constitutes acceptance of the updated Terms.
